A recent report from the U.S. Environmental Protection Agency about its own apparent mishandling of asbestos in demolition projects underscores the pervasive threat this cancer-causing material poses to Americans health, New York mesothelioma attorney Joseph W. Belluck said today.
If the governmental body charged with keeping us safe from environmental hazards can fail to protect its employees and contractors from asbestos exposure, it is frightening to consider the dangers faced by employees of less-conscientious organizations, said Belluck, a partner in Belluck & Fox, a New York personal injury firm that represents victims of asbestos exposure.
Belluck was referring to a December 14 memo from the EPAs inspector general that highlighted concerns about the use of unapproved demolition methods at EPA sites where asbestos was present.
Because inhaling asbestos fibers is known to cause lethal cancers such as mesothelioma, demolition crews are required to follow strict protocols to prevent exposure to the deadly material, Belluck said.
The EPA report indicated that unapproved asbestos-handling methods were in use at several sites, including one in Washington state and another in Kentucky. The inspector general also cited videos and photos that showed unprotected government workers and contractors present during experiments with unapproved alternative asbestos control methods in Arkansas and Texas.
Many of our clients developed mesothelioma or other asbestos-related diseases after being exposed to toxic asbestos at work decades ago, Belluck said. It is very alarming to think that workers are still facing exposure to this cancer-causing substance even at job sites that are under the control of the governments environmental watchdog.
Asbestos, which was once extensively used in a wide variety of applications, is the only known cause of mesothelioma. The disease is a rare but very aggressive form of cancer that usually affects the lining of the lungs. There is no known cure. Many victims do not develop mesothelioma until several decades after their exposure.
Because asbestos products remain in many older structures, the EPA has developed specific procedures for safer handling of asbestos during demolitions and renovations. The standards require specialists to remove asbestos-containing materials while minimizing the amount of asbestos dust produced.
Because the standards apparently were not followed at several EPA sites, according to the inspector general, the agency should notify workers and the public in the surrounding areas of the possibility that they were exposed to asbestos.
Belluck encouraged anyone who has developed an asbestos-related disease to seek qualified medical treatment. He also emphasized that it is important to consult with an experienced asbestos exposure attorney.

The demand for elder caregivers is growing rapidly as the population of the United States faces record growth in the elderly population. According to Phi Policy Works, approximately four million direct-care workers will be needed by 2016 to provide long-term services and support. CertifiedCare addresses the explosive growth, and with expansion comes regulations at the federal and state level to protect the safety and well being of this demographic.
According to the U.S. Bureau of Labor Statistics, there are three main categories for direct-care workers, each with their own specific set of duties:
Nursing Assistants/Nursing Aides Nursing Assistants work in nursing homes, assisted living environments, hospitals or some sort of community-based setting. They provide assistance with daily living activities including eating, bathing and dressing. Additionally, they perform clinical tasks like blood pressure readings.
Home Health Aides Home Health Aides are similar to Nursing Assistants in terms of services provided, however Home Health Aides usually operate out of the persons home under the supervision of a nurse or therapist. They may also help out around the house performing certain chores like laundry and preparing meals.
Personal/Home Care Aides Personal Care Aides (also referred to as Home Care Aides in some states) take care of household chores, such as laundry, cleaning, errands outside of the home that their patients are unable to complete, bathing assistance and meal preparation. Personal Care Aides also monitor the medical condition of their patients and administer medications and treatments as prescribed by the patients physician. They report the status of their client’s progress to their supervisor, who is usually a family member, home health aide, nurse or social worker.
Nursing Assistants/Aides and Home Health Aides are more medically involved, and are, therefore, required by the federal government to receive specific training and accreditation. Since Personal Care Aides, or PCAs, do not administer physically invasive therapies and do not have to work under the supervision of a nurse, there are no federal requirements in place for this job category. Certification for Personal Care Aides is imperative for the safety and well being of the elderly population, Dr. Cathleen Carr, executive director of CertifiedCare explains. It indicates a commitment to quality, a desire for career stability and development of an enduring skills set to help reduce elder abuse and neglect.
The federal government recognizes the importance of the progress of the Personal Care Aide field. In 2010, six states were awarded grants by the U.S. Department of Health and Human Services to create a training and credentialing program. The Personal and Home Care Aide State Training Program (PHCAST) is apart of a three-year demonstration program called the Affordable Care Act. California, Iowa, Maine, Massachusetts, Michigan and North Carolina received a total of $ 4.2 million for the project.
With no federal regulation in place, states are taking it upon themselves to implement certain initiatives. Legislation in California for example, requires each county in the state to create a record complete with referrals and a background check of independent care providers providing support and services under the In-Home Services (IHSS) program. A bill passed in Washington requires Home Care Aides to complete 75 hours of long-term care basic training and then pass a certification exam. The training includes core competencies and population specific competencies. Connecticut has pending legislation that if passed, would establish a Personal Care Aide Workforce Council to recruit and train Personal Care Aides.
Other states do not have their sights set solely on regulation for the Personal Care Aide/Personal Home Aide category. Rather, they are focused more on Direct Care Workers as a whole favoring the more medically intensive job categories of Nursing Assistants/Nursing Aides and Home Health Aides when setting up legislation. “This is where proposed legislation misses the mark, says Dr. Carr. It is the Personal Care Aide who can help reduce costs of care, reduce re-admissions to emergency rooms and improve the patients overall sense of well being. Not every elderly person requires a nurse to respond to every need. Most elder needs are not health related at all, rather the activities of daily living are what they need the most help with. This is where state action needs to be focused. Filling this gap in the eldercare at-home paradigm is why CertifiedCare exists.”

Ramtech Building Systems, Mansfield, TX has announced that the company has secured a new contract for the design, fabrication, and construction of five modular buildings for KIPP Delta Public Schools of Helena, Arkansas. The project will provide for three 8,100 square foot eight-classroom buildings, a 3,600 square foot food preparation and cafeteria facility, and a 3,600 square foot administrative office complex. The modular buildings will be delivered and installed prior to the start of the 2012-2013 academic school year at their new campus location in Blytheville, Arkansas. This will be Ramtech’s second modular school construction project for KIPP, one of the nations largest charter school providers serving more than 32,000 students at 109 schools in 20 states and the District of Columbia. The new campus location is part of a four-acre development designed by Stuck & Associates Architects of Jonesboro, Arkansas. Ramtech will provide the modular buildings as a subcontractor to Rowan Construction Services of Marianna, Arkansas the general contractor selected for the project.
According to Gary White, Ramtech’s vice president of sales and estimating, KIPP was very pleased with the project that we did for them at their San Antonio, Texas campus so they encouraged the architectural firm that they selected to work with us on the modular building designs for this job also. The announcement for the KIPP project coincides with Ramtechs preparation for the February 1, 2012 launch of their new program to promote the benefits of using modular construction for charter schools. The initiative will provide an opportunity for educators to learn about the recent innovations and practical applications in the use of temporary and permanent modular buildings when developing new schools or additions to existing campuses. To aid in this effort, Ramtech has installed a fully-finished six-classroom modular floor plan facility available for tours and viewing at their Mansfield headquarters.
The charter school movement has experienced large growth in recent years with more than 500 new charter schools opened in the 2011-2012 school year alone. According to the National Alliance for Public Charter Schools, nearly 2 million students nationwide are now enrolled in charter schools compared to 46 million students in traditional K-12 public schools. KIPP, which stands for the Knowledge Is Power Program, is a national network of free, open-enrollment, college-preparatory public schools with a track record of preparing students in underserved communities for success in college and in life. Nationally, more than 95 percent of KIPP middle school students have graduated high school, and more than 85 percent of KIPP alumni have gone on to college.
